USA JOB READY — Terms & Conditions and Privacy Policy

These Terms & Conditions and Privacy Policy ("Terms") govern your access to and use of the USA Job Ready web application, including every program, lesson, practice tool and certificate offered through it (together, the "App"). The App is operated by USA Job Ready ("USA Job Ready," "we," "us," or "our"). By accessing or using the App, creating an account, or otherwise interacting with the App, you agree to these Terms. If you do not agree, do not use the App.

If you use the App through a school, employer, community organization or other program partner (a "Program"), any separate agreement between you and that Program also applies.

1. Acceptance of Terms

Use of the App means you have read, understood and agree to these Terms. We may change these Terms at any time; changes take effect when posted with an updated "Last Updated" date. Continued use after changes are posted means you accept them.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may use the App only through a Program that provides you access, and only with any permission required by that Program or by law.

3. Accounts and Security

You must provide accurate information when you create an account and keep it current. You are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly at usajobready@gmail.com if you believe your account has been accessed without permission. We may suspend or close accounts that violate these Terms. You may ask us to close your account at any time.

4. Information We Collect

Information you give us: your name, email address, login credentials, and the Program or program code you join with.

What you do in the App: your progress, lesson responses, practice answers, the text of spoken answers, feedback and scores, and certificates earned. When you record a spoken answer, the audio is sent for transcription and is not kept by the App after it is converted to text.

Technical information: device and browser information, IP address, and identifiers used to keep you signed in and save your progress.

Please do not include sensitive personal information (for example health, financial or legal records) in your answers.

5. How We Use Your Information

We use information to provide and operate the App; create transcripts, feedback and scores, including with automated and artificial-intelligence tools; track progress and issue certificates; share progress with your Program; communicate with you about your account; maintain security; improve the App, our programs and our feedback, including by reviewing responses in de-identified or aggregated form; and meet legal obligations.

6. Automated and AI-Generated Feedback

Feedback, scores and sample answers in the App are generated automatically and may be incomplete or inaccurate. They are for practice only and are not professional, career or legal advice.

7. How We Share Information

We do not sell your personal information. We share it only:

• with service providers that help us run the App (such as hosting, speech-to-text, AI feedback, text-to-speech and email providers), who may use it only to provide their services to us;
• with your Program, including its staff and administrators, who may see your account details, progress, responses, scores and certificates;
• if required by law or legal process, or to protect the rights, safety and security of users, the public or USA Job Ready;
• in connection with a merger, acquisition or sale of assets; or
• with your consent.

8. Communications

By creating an account, you agree to receive transactional messages about your account and the App, such as password resets, security notices and program updates. These are not promotional. To stop them, close your account.

9. Cookies and Browser Storage

The App uses cookies and similar browser storage to keep you signed in, save your progress and remember your settings. We do not use them for advertising or to sell personal information. You can control cookies in your browser, but the App may not work without them.

10. Data Retention

We keep your information while your account is active and as needed to provide the App. You may ask us to delete your account and information at any time. We may keep information when required by law or for legitimate purposes such as security and dispute resolution, and we may keep de-identified or aggregated information.

11. Your Privacy Rights

Depending on where you live, you may have the right to know what information we have about you, to access, correct or delete it, and not to be treated differently for using these rights. We extend these rights to all users. Contact us at usajobready@gmail.com to use them; we will respond within 45 days.

12. Data Security

We use reasonable administrative, technical and physical safeguards to protect information. No method of transmission or storage is completely secure. If a breach affects your personal information, we will notify you as required by law.

13. Children’s Privacy

The App is not directed to children under 13, and we do not knowingly collect information from them. If we learn we have, we will delete it. Users aged 13 to 17 may use the App only through a Program, as described in Eligibility.

14. Your Content and Our Content

You own the answers and other content you submit. You give USA Job Ready a license to use that content to operate, provide and improve the App and our programs, as described in these Terms. All other content in the App — including text, lessons, audio, graphics, logos and design — belongs to USA Job Ready or its licensors and may be used only for your own personal, non-commercial use of the App.

15. Acceptable Use

Do not misuse the App: do not share your account, access others’ information, interfere with or overload the App, attempt to reverse-engineer it, use it to create or train other products, or submit unlawful, abusive or misleading content.

16. No Guarantee of Outcomes

Using the App or earning a certificate does not guarantee a job, an interview, admission to or completion of any Program, or any other outcome.

17. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR THAT ITS CONTENT OR FEEDBACK WILL BE ACCURATE.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, USA JOB READY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

19. Indemnification

You agree to indemnify and hold harmless USA Job Ready and its officers, directors, employees, agents and partners from claims arising out of your violation of these Terms or misuse of the App.

20. Third-Party Services and Links

The App may rely on or link to third-party services and websites. We are not responsible for their content, privacy practices or terms.

21. Changes and Termination

We may change, suspend or discontinue any part of the App at any time. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination will survive.

22. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be resolved exclusively in the state or federal courts located in California.
